Session Bills Released

The legislative bills for the 2018 Oregon legislative session have been released prior to session, which begins on February 5, 2018.  Click here for the list PIAO/I is following.

Our Oregon Government Relations Committee will discuss these bills to set a priority next week.  If you see anything that is of concern, be sure to let me know now.  We thank the members of our committee for their service in reviewing the legislation.

Identity Theft and Security Breach Bills

Of particular concern are thee bills relating to identity theft and security.  These bills were drafted after the Equifax breach.  These bills overlap with existing regulations and model laws.

This bill contains the creation of a private right action that allows a separate lawsuit without showing an actual consumer harm:

Section 9: “a court may award a person who initiates an action under this section an incentive award of up to 25 percent of the total monetary recovery if that person pursues the action to final judgment

as the prevailing party...”

Public Safety Assessment Fund Bill

SB 1553 https://olis.leg.state.or.us/liz/2018R1/Downloads/MeasureDocument/SB1553/Introduced requires insurers, fraternal benefit societies and nonprofit corporations to register with the Secretary of State and pay a 1.9% assessment, which funds a Public Safety Assessment Fund. 

The definition of insurer under ORS 731.106 is “Insurer - “Insurer” includes every person engaged in the business of entering into policies of insurance.”  We are working with DCBS to figure out if that includes independent insurance agents.  We will also ask the bill sponsor if this bill affects all non-profits.

HB 4055
Modifies laws related to vehicular hit and run.

HB 4063
Permits operation of autonomous vehicles on highways in this state under certain circumstances. Directs owners of commercial autonomous vehicles to obtain additional motor vehicle liability insurance policies. Directs Department of Transportation to adopt rules for operation of autonomous vehicles on highways in this state.
